The 12 essential clauses
1. Parties and identification. 2. Services and deliverables. 3. Payment schedule. 4. Cancellation and refund. 5. Reschedule for weather/illness. 6. Copyright retention by photographer. 7. Usage rights granted to client. 8. Model release. 9. Delivery timeline. 10. Liability cap. 11. Force majeure. 12. Governing law and venue.
Each clause should be one paragraph max. Long contracts get skimmed; short clear contracts get read. Print to one page if you can.
Sample language for the 3 most-disputed clauses
Cancellation: 'Client may cancel up to 30 days before the event for a full refund of any amount paid above the non-refundable retainer (currently $X). Cancellations 30 days or less before forfeit the full contract amount.'
Copyright: 'Photographer retains all copyright and reproduction rights to the images. Client receives a non-exclusive, perpetual license to display, share, and print the images for personal, non-commercial use. Commercial use requires a separate license.'
Delivery: 'Photographer will deliver an online gallery of edited images within X weeks of the event date. If delivery is late by more than 14 days, client may request a 10% credit toward a future session.'
What about AI usage rights?
New for 2026: many contracts now include a clause about AI training. Sample language: 'Client agrees not to use the delivered images to train, fine-tune, or evaluate any AI/ML model without explicit written consent from the photographer.' This is increasingly common and is being adopted from the music and illustration industries.
